1. Acceptance of Terms
By accessing or using MealSlash, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service. Your continued use of the service after any modifications to these terms constitutes your acceptance of such changes.
2. Description of Service
MealSlash acts as a purchasing intermediary and merchant of record. When you place an order, you authorize MealSlash to place a corresponding food delivery order with third-party platforms (such as Uber Eats, HelloFresh, etc.) on your behalf. MealSlash processes your payment directly and handles any applicable customer service or refunds related to that transaction. We are not a food delivery service ourselves but rather facilitate discounted orders through existing delivery platforms using our own corporate accounts.
3. User Responsibilities
You are responsible for: • Providing accurate and complete information when placing orders, including delivery addresses and contact details • Maintaining the confidentiality of your account credentials • Not misusing the platform or placing fraudulent orders • Understanding that once an order is placed and confirmed, it cannot be canceled unless otherwise stated • Ensuring you have sufficient funds available for payment • Reporting any suspicious activity immediately • Accepting responsibility for all activities that occur under your account
4. Order Processing and Payment Terms
By submitting payment through MealSlash, you authorize us to charge your selected payment method for the total amount due. MealSlash processes payments directly and is not a payment intermediary of the restaurant or third-party delivery platform. All prices displayed are in the currency specified and do not include delivery fees, tips, or applicable taxes unless explicitly stated. Payment must be completed before order processing begins.
5. Delivery and Refunds
If the order is delivered, we do not offer refunds. MealSlash is not liable for the faults of the delivery driver or delivery service. Any issues related to the delivery itself should be directed to the respective delivery service. All refund requests are handled by MealSlash and subject to our internal investigation. Refunds are issued at our sole discretion, typically only in cases of fraud, platform error, or failure to deliver. MealSlash does not guarantee refunds for dissatisfaction with third-party food quality or delivery. In cases where an order is not delivered at all, we will review refund requests on a case-by-case basis.
6. SMS/Text Message Terms
The MealSlash mobile message service (the "Service") is operated by MealSlash ("MealSlash", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes. By consenting to MealSlash's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of MealSlash through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders). We may store SMS logs for security and audit purposes. Your phone number may be used for order confirmations and account verification. You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with MealSlash. Your participation in this program is completely voluntary. We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider. You may opt-out of the Service at any time. Text the single keyword command STOP to +18777671625 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other MealSlash mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
7. Service Availability and Third-Party Platforms
MealSlash reserves the right to limit or refuse service to any user or in any geographic area at our sole discretion. We do not guarantee that our service will be available in all locations or for all restaurants. We are not responsible for delays or fulfillment issues resulting from third-party platforms. You acknowledge that MealSlash cannot guarantee the quality, timing, or availability of food items ordered via these platforms.
8. Limitation of Liability
To the maximum extent permitted by law, MealSlash shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. We are not responsible for delivery issues (delays, missing items) caused by third-party platforms. Our total liability to you for any claims arising out of or related to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the liability.
9. Tax and Fees
Users are responsible for any applicable local taxes and fees unless otherwise stated. These may be included in the final order total. All prices are subject to change without notice. MealSlash reserves the right to adjust prices, fees, and taxes at any time.
10. Dispute Resolution
Any dispute, claim or controversy arising out of or relating to these Terms, the breach thereof, or the use of the Services shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware, USA, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall be conducted on an individual basis and not as a class action. Each party shall bear its own costs and expenses, including attorney fees, unless the arbitrator(s) determine that a party has acted in bad faith. You waive your right to participate in any class action or class-wide arbitration.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes by updating the 'Last Updated' date at the bottom of these Terms. Your continued use of the platform after changes have been made constitutes your acceptance of the modified terms. If you do not agree to the modified terms, you must discontinue using our service.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of Delaware. You consent to the jurisdiction of such courts and waive any objection to venue.
